These Terms of Service ("Terms") govern your use of SMSPM bulk SMS messaging services provided by iSMS Solutions OÜ. By creating an account, accessing our platform, or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our services.

SMSPM provides bulk SMS messaging services including:

• SMS Gateway API: HTTP API for sending SMS messages from applications and websites
• Web-based Dashboard: Online platform for managing SMS campaigns and contacts
• Bulk SMS Sending: Send messages to multiple recipients simultaneously
• Global Coverage: SMS delivery to over 200+ countries and 800+ mobile networks
• Message Scheduling: Send SMS messages at specified times
• Delivery Reports: Real-time status updates on message delivery
• Contact Management: Organize recipients into groups and manage contact lists
• Message Templates: Create and save reusable message templates

To use our services, you must:

• Create an account with accurate and complete information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account without authorization.

Permitted Uses

You may use our services for:

• Legitimate business communications and marketing to opted-in recipients
• Transactional messages (order confirmations, appointment reminders, etc.)
• Account notifications and alerts
• Information services to consenting recipients
• Authentication and verification messages (OTP codes)

Prohibited Uses

You may NOT use our services for:

• Sending spam, unsolicited messages, or messages to non-consenting recipients
• Illegal activities or promoting illegal content
• Harassment, threats, or abusive messages
• Adult content, gambling, or illegal substances
• Phishing, fraud, or deceptive practices
• Messages that violate recipient privacy or data protection laws
• High-volume messaging without proper opt-in procedures
• Chain letters, pyramid schemes, or similar content

Our pricing model:

• Pay-as-you-go: No monthly fees, contracts, or hidden charges
• Pre-paid Credits: Purchase SMS credits in advance
• Per-message Pricing: Costs vary by destination country and network
• No Setup Fees: Free account creation and API access

Current pricing is available on our website. Prices may change with notice. Unused credits do not expire but accounts inactive for 12+ months may be subject to maintenance fees.

While we strive for high availability, we do not guarantee:

• 100% uptime or uninterrupted service access
• Delivery to all mobile networks or numbers
• Specific delivery timeframes for all destinations
• Continued service to all countries (due to regulatory changes)

SMS delivery depends on recipient network conditions and may be affected by carrier filtering, network congestion, or technical issues beyond our control.

We are committed to protecting personal data in accordance with applicable laws:

• We process recipient phone numbers solely for message delivery
• We do not sell, rent, or share your contact data with third parties
• You remain responsible for obtaining proper consent from message recipients
• You must comply with applicable privacy and data protection regulations
• Our detailed Privacy Policy governs how we handle personal data

Rights and ownership:

• SMSPM and associated trademarks are our property
• You retain rights to your message content and contact data
• You grant us limited rights to process your data for service delivery
• You may not use our intellectual property without written permission

Our liability is limited as follows:

• Total liability limited to the amount paid for services in the preceding 12 months
• We are not liable for indirect, consequential, or punitive damages
• We are not responsible for recipient actions or third-party service failures
• Message delivery is not guaranteed due to factors beyond our control

Some jurisdictions may not allow liability limitations, in which case limitations apply to the maximum extent permitted by law.

Either party may terminate the service relationship:

• By You: Close your account at any time through our platform
• By Us: Immediate termination for Terms violations or illegal activity
• Suspension: We may suspend services for suspected violations pending investigation
• Refunds: Unused credits may be refunded at our discretion (minus processing fees)

You agree to comply with:

• All applicable laws and regulations in your jurisdiction
• Anti-spam laws (CAN-SPAM Act, GDPR, etc.)
• Telemarketing and consumer protection regulations
• Data protection and privacy laws
• Industry standards and best practices for SMS marketing

We reserve the right to refuse service to jurisdictions with restrictive regulations or where compliance is not feasible.

You agree to indemnify and hold harmless iSMS Solutions OÜ from claims arising from:

• Your use of our services in violation of these Terms
• Your message content or marketing practices
• Violations of third-party rights or applicable laws
• Unauthorized use of your account

These Terms are governed by the laws of Estonia. Any disputes will be resolved through:

• Good faith negotiations between the parties
• Binding arbitration if negotiations fail
• Courts of Estonia for matters that cannot be arbitrated

We may update these Terms from time to time:

• Notice will be provided via email or platform notification
• Material changes will have a 30-day notice period
• Continued use constitutes acceptance of updated Terms
• You may terminate your account if you disagree with changes
